Ellen also recently served as trial counsel to the Trustees of the University of Pennsylvania in a patent infringement action against Eli Lilly and ImClone related to an antibody treatment for certain cancers, which resolved on confidential terms days before trial.Įllen is no stranger to the courtroom, even in her early years of practice. For instance, Ellen recently defended Upsher-Smith in Hatch-Waxman patent litigation related to five patents covering Absorica® (Isotretinoin) Capsules, the settlement of which allowed Upsher-Smith to launch its product commercially nearly three months before the Orange Book-listed patents’ expiration date.
